Event Operation Specialists Ltd.
Terms and Conditions
The rules for using the EOS Staff app and the EOS staff web app.
1. About these terms
These terms apply when you use the EOS Staff app and the EOS staff web app (together, the “app”). The app is run by Webb Click Ltd on behalf of Event Operation Specialists Ltd. (“EOS”, “we”, “us”), a company registered in England and Wales 16966557 with its registered office at Croft Way, Hampton Hargate, Peterborough, England, PE7 8BL. Contact: eosevents.mail@gmail.com.
By creating an account or using the app you agree to these terms. If you do not agree, please do not use the app. How we use your personal data is explained in our Privacy Policy.
These terms cover your use of the app. They do not set out the terms on which you work at an event, your pay or your employment or engagement status. Those are covered by your separate agreement with EOS.
2. Who can use the app
- The app is for people who work, or want to work, at events for EOS. You must be at least 18 years old.
- You must be legally entitled to work in the United Kingdom.
- New accounts are reviewed by EOS. We may approve, refuse or delay an account at our discretion.
3. Your account
- The details you give us must be true, complete and kept up to date. This includes your name, contact details, date of birth, National Insurance number, address and bank details.
- You may have one account only. It is personal to you, and you must not let anyone else use it.
- Keep your sign-in method secure. Sign-in links sent to your email address or phone are for you alone. Tell us straight away if you think someone else has used your account.
- You are responsible for what happens under your account unless you have told us it has been compromised.
4. Events, shifts and attendance
- Registering interest in an event does not guarantee you a shift. A shift is only yours once EOS has assigned it to you and, where the app asks, you have confirmed it.
- If you accept or are assigned a shift, we are counting on you to attend. If you can no longer attend, tell us as early as you can, using the app where it allows, or by contacting us.
- Repeatedly declining, cancelling late or not turning up for shifts may lead us to restrict or close your account.
- Shift details can change. We will tell you through the app, by email or by notification, and you should check the app before each shift.
5. Safety briefings and paperwork
- Some events require you to complete a safety briefing before you can start work. You may be unable to clock on until you have done so.
- You must follow the instructions of your supervisor and the health and safety rules at each event.
- Forms you sign in the app, by typing your name, are electronic signatures. You confirm that the information in them is true to the best of your knowledge, and that you have read and understood them.
6. Clocking on, breaks and your hours
- Your supervisor, or the app, records when you clock on, take breaks and clock off. This is the basis for your hours.
- After a shift, your supervisor reviews your hours and the app asks you to confirm them. Please check them carefully. If something is wrong, use the option to query it before you confirm.
- Once you confirm your hours they cannot be changed in the app. Payment is made on the basis of confirmed hours, in line with your separate agreement with EOS.
- Hours you do not confirm may be held back until you have done so.
7. Using the app properly
You must not:
- give false information, or clock on, confirm hours or sign forms on behalf of someone else;
- try to access another person’s account or information, or any part of the app you are not permitted to use;
- interfere with the app or its security, or use it to send anything unlawful, abusive or misleading;
- copy, reverse engineer or resell any part of the app, or use automated tools to collect information from it; or
- use the information in the app, such as other people’s names or contact details, for any purpose other than your work for EOS.
8. Notifications
We send emails, text messages and app notifications about your account, shifts, briefings, hours and paperwork. These are part of how the app works. You can switch off push notifications in your device settings, but you may then miss important information about your shifts.
9. The support assistant
Supervisors may have access to a support assistant called Dave. Dave is an automated assistant that answers questions about using the app from our own guidance. It can make mistakes and is not legal, financial or safety advice. If an answer matters, check with EOS.
10. Our content and the app
EOS has the right to use, the app, its design, and logos and content. You may use the app for the purposes set out in these terms, but you do not acquire any ownership of it.
11. Availability and changes to the app
We aim to keep the app available, but we cannot promise it will always work without interruption or error. We may change, suspend or withdraw features, for example for maintenance or to improve it. Please keep the app updated, as older versions may stop working.
12. Our responsibility to you
- Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit. Your statutory rights are not affected.
- Subject to that, we are not liable for losses that were not a reasonably foreseeable result of our breaking these terms, for loss of profit or business, or for losses caused by events outside our reasonable control, including problems with your device, network or the services we rely on.
13. Suspending or ending your account
- You can ask for your account to be deleted at any time from the Profile tab (Delete Account & Purge Data). If you have current or upcoming shifts, or hours still to be confirmed, please contact us first, as these need to be dealt with before the account can be closed.
- We may suspend or close your account if you break these terms, give false information, put anyone’s safety at risk, or if we no longer need to use you for events. Where it is reasonable to do so, we will tell you why.
- Some records, such as payroll and tax records, are kept after your account is closed where the law requires it, as explained in our Privacy Policy.
14. Changes to these terms
We may update these terms, for example if the app or the law changes. We will post the new version on this page and, for significant changes, tell you through the app or by email. If you carry on using the app after the change you are agreeing to the updated terms.
15. General
- If any part of these terms is found to be unenforceable, the rest still applies.
- If we do not enforce a right straight away, we can still do so later.
- These terms, and any dispute about them or the app, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, except that if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
